PROPOSED LICENSE TO EXPORT COMPONENTS TO VENEZUELA (XCOM0346)
Purpose:
Commission review of proposed issuance of component export license to Reuter Stekes, Inc.
This license request is being forwarded for Coninissioner review in accordance with 10 CFR 9110.40(b)(5) because the proposed export of equipment is destined to a country to which the Commissioners have not previously authorized an export pursuant to the NNPA of 1978.

On December 20, 1979, Reuter Stokes, Inc. applied for a license to export two ionization chambers, valued at $5,079, to Venezuela for use as neutron detectors in the RV-1 Research Reactor located at Caracas (Appendix A).
The RV-1 reactor is a U.S.-designed, 3 megawatt thermal, light water moderated and cooled, graphite reflected reactor, utilizing 20 percent uranium.
The reactor has been in operation since April 1960 and is used in research, training, and materials testing. The reactor is under IAEA safeguards and is covered by a facility attachment.
In a letter dated April 16, 1980 (Appendix B) the State Depart-ment informed NRC that it is the view of the Executive Branch that Venezuela meets the three export licensing criteria under 10 CFR 110.42(b) and under section 109 of the Atomic Energy Act, as amended, for the export of nuclear equipment.
The first two criteria, (1) application of IAEA safeguards to the equip-ment and (2) no nuclear explosive use of the equipment, are met by Venezuela's adherence to the hPT.
The third criterion, no retransfer of U.S.-supplied components without prior U.S. approva is met by Venezuela as confirmed in a letter dated April 7, 19 from the Embassy of Venezuela which was attached to the Ex Branch views. The staff agrees that the three criteria met.

. As required by Section 109(b) of the Atomic Energy Act and 6110.44(a)(1)(ii) of Part 110, the staff has concluded that the proposed export would not be inimical to the common defense and security of the United States or constitute an unreasonable risk to public health and safety.
NMSS Technical The RV-1 reactor is covered by IAEA safeguards under an IAEA-Review:
Venezuelan project agreement and a trilateral agreement.
Although we have no information on the adequacy of safeguards implementation in Venezuela, NMSS believes that the export of these components would create no safeguards concerns.
The export of these components is not subject to the physical security requirements of 10 CFR 110.42 and 110.43.
Recommendation:
That the proposed license be issued to Reuter Stokes, Inc.
