O APPENDIX A NOTICE OF VIOLATION National Bureau of Standards Docket No.70-398 Based on the results of an NRC inspection conducted on February 27-29, 1980, it appears that one of your activities was not conducted in full compliance with NRC regulations and the conditions of your NRC facility license as indicated below.
This item is an infraction.
10 CFR 71.12 states, in part, that a general license is hereby issued to persons holding a general or specific license issued pursuant to this chapter, to deliver licensed material to a carrier for transport, provided the licensee has a quality assurance program, whose description has been submitted to and approved by the Commission as satisfying the provisions of paragraph 71.51.
10 CFR 71.51(a) states, in part, that a description of that program shall be filed, in accordance with this section, by Janaury 1,1979....
If a person has filed such a description, the continued use of his existing quality assurance program is authorized until the acceptability of the program has been finally determined by the Commission.
Contrary to the above, as of February 28, 1980 a description of the Quality Assurance Program for Shipping Packages satisfying the provisions of paragraph 71.51 hac not been submitted to or approved by the Commission and at least 27 shipments of fissile radioactive materials in excess of type A quantities had been made between January 10, 1979 and December 10, 1979.
