SUBJECT:

PARTIAL REFUND OF CP FEE - YELLOW CREEK 1&2 On May 7,1980, a meeting was held with Mr. Donoghue and Mr. Fonner 0 ELD to discuss the above subject. All program offices except the Atomic Safety and Licensing Appeal Panel (ASLAP) reporteti their manpower expended on the construction permit review to LFMB.

In his memorandum dated December 15, 1978 Mr. Rosenthal, Chairman, ASLAP, indicated that they would provide LFMB with the manpower expended when the sua sponte review was com-pleted.

In subsequent telephone conversations with Mr. Rosenthal, he indicated that although the costruction permits had been issued, there was one item that was still open; namely,the radon issue.

He stated that the Commission had decided that the radon issue would be adjudicated in 17 separate CP cases.

He expected the issue to remain open for another eight months to a year.

Mr. Rosenthal further stated that he would be unable to provide LFMB with the manpower expended on the Yellow Creek review until such time as the radon issue has been resolved.

Based on the manpower and contractual services costs expended by the other program offices for the review of Yellow Creek 1&2, the Tennessee Valley Authority (TVA) is due a refund of approximately $290,000.

Rather than delay the refund for several months waiting for the ASLAP data, it was decided that we would use the ASLAP average of 6 professional man-days (NUREG 0268) and proceed to make the refund to TVA.
