Mr. J. A. Kelly, Jr.

President 161 E. 42nd Street New York, NY 10017

Dear Mr. Kelly:

This refers to the discussions held in our office on January 23, 1980, with you regarding the requirements for shipping machinery contaminated with byproduct material to a foreign country where the receiver possess-es a license from that country to possess the byproduct material. We have discussed this matter with NRC headquarters and they have sent the attached reply.

It appears that you can ship this machinery if you have a specific export license for the byproduct material.

If you plan on exporting this machinery as contaminated, you should contact Elaine Hemby, (301) 492-7984, concerning a specific export license.

If you have any other questions on this matter that this office could help you with, do not hesitate to call C. J. Paperiello (312) 932-2511.

Sincerely,

,)
