This is in resmnse to your letter dated My 6,1980 in which you requested, pursuant to the Freedom of Information Act, a copy of WASH-740, WASH-1250, NUREG-0660, (Draft 3), and NUREG-0460.

You may purchase a copy of the documents listed in Appendix A for the price indicated, by sending a check payable to the Superintendent of Documents to Ms. Linda Schneider, Publications Unit, U.S. Nuclear Regulatory Commission, Washington, DC 20555.

NUREG-0660, Draft 3, is no longer available.

The final' report will be published at the end of this month.

You may write to Ms. Schneider at the above address for its availability.

NRC regulations concerning waiver of fees are. set forth in 10 CFR 9.14a (copy enclosed).

Section 9.14a(g) provides that the "NRC will not waive the reproduction costs of documents located or made available in the NRC Public Document Room... in the absence of a compelling reason to do so."

The publications you have requested are available in the Public Document Room and through the GP0 sales program. Thus, lacking any showing of compelling need, your request for a fee waiver is denied.

The person responsible for this denial is the undersigned.

This denial may be appealed to the Commission's Executive Director for Operations within 30 days form the receipt of this letter.

As provided in 10 CFR 9.11, any such appeal must be in writing, addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Commission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision."
