SUBJECT:

MAINE YANKEE SEISMIC ANALYSIS ORDER I have reviewed the proposed order of May 16th and have one recom-mendation regarding it.

On page 5 of the proposed order, the first paragraph discusses the inherent seismic conservatism in the facility design.

I believe this paragraph is inappropriate in the order.

It is not supported by material in the SER, nor is it essential to the order.

It is neither addressed in the ori inal order nor, therefore, a statement necessary to follow 9

on to the original order.

Therefore, I believe it should be removed from the order.

If the staft believes the subject matter is important to the decision being reached, I believe that a discussion of the seismic conservatisms should be in the SER.

In addition, I believe that the sentence "The NRC will be further reviewing the subject of seismic design capability..." is more cor-rectly stated "The NRC will be further considering the issue of seismic design capability..."
