Dear Mr. Tappan:
This is in reply to your letter dated May 8,1980, in which you requested, pursuant to the Freedom of Information Act, copies of two reports you identified as well as a copy of the NRC's Gray Book dated January,1980.
In response to your request, we have identified the documents listed in Appendix A as being subject to your request.
A copy of each document is enclosed.
As explained by Mr. Frank W. Karas of this office in a telephone conversation with you on May 15, 1980, the charge for reproducing records not located in the NRC Public Document Room is ten cents ($0.10) per pace, as specified in 10 CFR 9.14(b), a copy of which is enclosed.
Accordingly, the cost of reproducing the enclosed 458 pages of Appendix A documents 1, 2, and 3 is $45.80.
Please send a check in the amount of $45.80 along with a copy of this letter to the Director, Division of Rules and Records, Room MNBB-4210, U.S. Nuclear Regulatory Commission, Washington, DC 20555.
In response to your question on a waiver or reduction of fees, please note that normally a request for fee waiver is to be made at the time the initial request for records is made (59.14(b)(5)), and that the NRC's regulations provide that in making a request for waiver or reduction of fees, the requester shall provide a statement setting forth the information required in 59.14a(c).
Finally, as Mr. Karas explained, we have no record of having received your previous request.
