Dear Mr. Ballard:

Attached is a draf t ikmorandum of Agreement between Rock Island and St. Paul Districts of the Corps of Engineers which redesignates the area over which each District has jurisdiction for review of matters pertaining to regulatory func-tions. Because the Lacrosse Boiling Water Reactor is located in one of the areas where such jurisdiction has been transferred to St. Paul District, I am requesting that you send copies of the referenced EIS to:

District Engineer US Army Engineer District, St. Paul 1135 USP0 & Custom House St. Paul, Minnesota 55101 The Rock Island District retains Corps of Engineers review responsibility for all aspects, other than regulatory functions, of projects stich are located within this District. It is for this reason that we are retaining our copy of the referenced EIS, and request you send duplir. A :es to St. Paul District as soon as possible so they can also complete their review within the normal time frame.

For project documents which require review in the future, please send copies to both Rock Island and St. Paul Districts' whenever the project falls within those areas designated in the MOA.

MEMORANDUM 0F AGREEMENT I.

Pursuant to the recent decision of the Division Engineer, North Central Division, that the St. Paul District exercise lead District responsibility for all regulatory functions within the State of Wisconsin, the undersigned join in this agreement in order to define and clarify the procedures by which the Rock Island District will transfer its regulatory functions responsibilities for the State of Wisconsin to the St. Paul District.

O II. Accordingly, the Rock Island District agrees to provide to the St.

Paul District the following:

1.

All active pemit files for the State of Wisconsin, including violation / surveillance files.

2.

All closed / inactive pemit files for the State of Wisconsin, including violation / surveillance files.

3.

All general permits applicable in the State of Wisconsin (copies are acceptable).

All available aerial photos for the State of Wisconsin.

All available maps and plat books for the State of Wisconsin.

6.

All navigability studies for waters of the State of Wisconsin.

7.

All scientific or technical studies / reports concerning resources of the State of Wisconsin.

A list of all Corps civil works or navigation projects in the State of Wisconsin.

Mailing list of agencies / individuals interested in regulatory functions in the State of Wisconsin.

O III.

Further, the Rock Island and St. Paul Districts hereby agree to readjust their previous District boundaries for regulatory functions respon-sibilities by an exchange of counties, or portions thereof, in the States of Iowa and Minnesota.

By this agreement, the Rock Island District will assume regulatory functions responsibilities for those portions of Emmet, Kossuth, Winnebago, Mitchell, Howard, Winneshiek, Alla.makee and Clayton Counties.

Iowa; which were fo. nerly within the administration of the St. Paul District.

Correspondingly, the St. Paul District will assume regulatory functions respesibilities for those portions of Cottonwood, Jackson, Martin, Murray, Nobles, Freeborn, Steele, Dodge, and Mower Counties, Minnesota; which were 2

formerly within the administration of Rock Island District. This nutual rha'djustment of regulatory functions boundaries include the exchange by the respective Districts of those items set forth in Paragraph II., above

'(items being pertinent to the Iowa / Minnesota counties that are the subject of this agreement).

IV.

Further, both Districts agree tnat they will keep the other District's Regulatory functions Branch advised of Corps civil works or navigation projects within their respective non-regulatory functions Districts so that permit applicants can be notified of the need to obtain the respective District Engineer's approval for proposed actions that may impact on Corps projects.

The Rock Island and St. Paul Districts agree to forward annually, or more frequently if dec..:ed appropriate, an updated list of Corps projects. Subse-quently, each District will notify the other, by public notit.e, of all proposed actions withifi its counterpart's project areas.

All provisions of this agreement will become effective on 1 June 1980, and all items to be provided by the terms of this agreement will be forwarded by 10 May 1980.
