Enclosed clease find a February 11, 19E: c:olication fr:n Westinghouse Electric Corcoration for a license to ex:c-an incore #ission chamber containing SM1 to Australia for use a: :P.E Lucas Heigh s nuclear reactor facility. As you are aware, the SN" cor-i:n of this ex: ort will not re:uire a soecific 'RC license effective April 21, 1930. Althc;gh the equioment does not normally require Executive Eran:P review, we w:uld aopreciate your views on this crocosed excort, because tne excort is t a country which tr.e Commissioners have not oreviously authori:ed an exoort :ursuant to the.'m:A of 1978. Under t!RC's recently revised delegaticas of a.;thority, componen-exports destined to countries which fall Sto this category now require Commissicner review before a license is issued.
The NRC has received from DOE a March 21, '.920 letter cf assurance from the Government of Australia stating that the material covered by the license anolication will be subject to all the :ers and conditions of the U.S.-
Australia Agreement for Cooceration.
AltP.:uch this assurance was soecifically requested to cover the SM" portion o# the ex? ort, we wc;1d like your views as to whether the 'iarch 24, 1980 letter also sets the ao:licable 109(b) criteria in the Atomic Energy Act as amended by tb.e ';*PA of 197E which covers co.ocnent exports.
Your exceditious response would be aooreciated as the a:olication was originally received by the NRC in February.
