APPENDIX A NOTICE OF VIOLATION Rensselaer Polytechnic Institute Docket No. 50-225 Based on the results of an NRC inspection conducted on February 13-14, 1980, it appears that certain of your activities were not conducted in full compliance with conditions of your NRC Facility License No. CX-22, as indicated below.

Item A is an infraction and Item B is a deficiency.

A.

10 CFR Part 50.54(J) states:

" Apparatus and mechanisms other than controls, the operation of which may affect the reactivity or power level of a reactor shall be manipulated only with the knowledge and consent of an operator or senior operator licensed pursuant to Part 55 of this chapter present at the controls."

10 CFR Part 50.54(K) states:

"An operator or senior operator licensed pursuant to Part 55 of this chapter shall be present at the controls at all times during the operation of the facility;"

Contrary to the above at approximately 6:30 P.M. on February 13, 1980, a reactor startup was commenced by non-licensed student operators without the knowledge and consent of the licensed operator and without the licensed operator present at the controls.

B.

Technical Specification 6.2.7 states in part:

"The Nuclear Safety Review Board shall:

Audit reactor operations and reactor operational records for compli-e.

ance with internal rules, regulations, and procedures and with licensed provisions, including Technical Specifications.

f.

Audit existing Operating Procedures for adequacy and to assure that they achieve their intended purpose in light of any changes since their implementation.

I g.

Audit plant equipment performance with particular attention to oper-ating anomalies, abnormal occurrences, and the steps taken to identify and correct their causes."

Contrary to the above, as of February 14, 1980, the Nuclear Safety Review Board has not conducted any audits concerning facility operation, operating c ocedures, or equipment performance.
