This motion is based on the progress of very meaningful settlement negotiations among certain private parties which could lead to a resolution of part or all

of these proceedings.

Movants jointly submit to the Board that I

such a modest extension is warranted and will serve the interests j

' of judicial economy and the Commission's policy to encourage compromise.

As the Board is aware, certain private parties in recent weeks have continued their efforts to attempt to settle the underlying controversies between themselves which constitute a substantial part of these cases.

The settlement negotiations have reached a point where these parties can r9present to the Board that, if the extension is granted, there is a reasonable probability that the substantial matters in issue in this dis-pute can be resolved and settled, among at least some, and perhaps all of the parties.

Additional time is needed to formalize the understandings which now appear to present a basis for possible resolution of this dispute and to fully apprise and include the governmental parties in the negotiations.

Given the current time frame, it simply is not possible to complete preparation for the hearing while simultaneously attempting to consummate the settlement negotiations.

Moreover, at this sensitive and pivotal stage in the process, the filing of trial briefs and exhibits would effectively rigidify the parties' positions, constraining negotiations.

The parties recognize the exigencies of time, and the important interests of the Commission and the Board in moving this matter to an expeditious resolution.

It is respectfully submitted that the modest extension requested here would serve to further these interests significantly by permitting the possible resolution of substantial matters ndw in dispute.

l With the exception of the Department of Justice and the Public Utilities Board of Brownsville, this motion is joined El in by all parties in these proceedings.

For these reasons, the moving parties respectfully request the Board to grant the extension of time herein requested, and extend all procedural dates in this proceeding for 30 days.
