The Department of Justice and the Nuclear Regulatory Com-mission (hereinaf ter referred to as "Movants") enclose herewith their Joint Motion of the Department of Justice and the Nuclear Regulatory Commission Staff for Modification of Board Order Re-garding Protection of Settlement Discussions and for an Order to Compel -Production of Certain Documents and Testimony.

Because the Board's ruling on this Motion will have a di-rect bearing on depositions scheduled these last few days of factual discovery, i.e.,

(discovery closes on March 14, 1980)

Movants request the following expedited schedule:

March *3, 1980 - Responses to Motion hand-delivered to Board and Movants.

March 4, 1980 - Telephone Conference Call With Board To Be Scheduled at the Board's Con-venience by the Department of Justice.

ORDER ACCELERATING RESPONSES TO DEPARTMENT OF JUSTICE AND THE NUCLEAR REGULATORY COhMISSION STAFF'S MOTION TO COMPEL (February 28, 1980)

On February 28, 1980, the Department of Justice and the Nuclear Regulatory Commission Staff ("Movants") filed their Motion for Modification.

Copies of that motion and an accom-panying cover letter were hand-delivered to the Board, Houston Lighting & Power Company and Texas Electric Utilities Generat-ing Company on that date.

The Board finds that Movants have stated good cause for an acceleration of the time within which responses should be f iled to this matter.

Therefore, pursuant to 10 CFR S2.711(a),

the Board orders the following schedule be adopted:

Counsel for the Department shall be responsible for arranging the conference call among the Board, any party responding to the motion, and itself.
