This is in regard to your hequest for an approved spent fuel route as described in your letters.of December 5,1979, January 29, 1980 and February 13, 1980.
The route and law enforcement contact information (enclosed) provided us by your letter of February 13, 1980 is considered to meet the require-ments of 10 CFR Part 73.37 and accordingly is approved. Please provide it to your carrier along with instructions regarding its use.
Please note that assuring highway safety is the responsibility of the licensee and the carrier and our approval is not intended to provide j
relief in this regard.
Furthemore, the approval does not sucrantee that there will be no local or state legislation applicable to the route that restricts or prohibits the movement of radioactive materials.
You are reminded that the notification requirements of 10 CFR Pa t 73.72 for each individual shipment still apply.
Since the enclosures to your proposals dated Decenber 6, 1979, January 29, 1980 and February 13, 1980 contain information of a type specified in 10 CFR Part 2.790(d), they are deemed to be contorcial or financial infor-nation within the meaning of 10 CFR Part 9.5(a)(4) and shall be subject to disclosure only in accordance with the provisions of 10 CFR Part 9.12.
For the same reason, the enclosure to this letter is being withheld.
