ORDER Ga January 16, 1980, the Commission decided to review an issue related to the petition for late intervention of the Upper Skagit Tribe, the Sauk-Suiattle Tribe, and the Swinomish Tribal Community, in the Skagit construc-tion permit proceeding.
In that order granting review, the Commission directed the NRC staff to invite the participation amicus curiae of the Department of the Interior for this review. The Department has accepted but has moved for a 60-day extension of time within which to file its views.
Only the applicant has opposed that motion.

Having invited the views of another agency on this matter before it, the Commission believes that it should not place a strict filing require-ment upon that agency.
Thus, pursuaist to 10 CFR 2.772(b), the Department's motion is granted and it may file its views amicus curiae by April 15, 1980.
The parties are advised that the Commission will consider, in a preliminary 1

2 way, the parties' briefs in order to mitigate the effects of delay brought by the grant of this motion.
