NOTICE OF NO OBJECTION FOR PRELIMINARY AMENDMENT REQUEST (PAR 19-014), TORNADO MISSILE PROTECTION FOR MAIN STEAM VENT STACKS AND WALL 11, FOR THE VOGTLE ELECTRIC GENERATING PLANT UNITS 3 AND 4

Dear Mr. Whitley:

By letter dated November 13, 2019, Southern Nuclear Operating Company (SNC) submitted Preliminary Amendment Request (PAR)19-014 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML19317F386). SNC notified the U.S. Nuclear Regulatory Commission (NRC) that absent NRCs objection and pending the outcome of the NRCs detailed technical review of License Amendment Request (LAR)19-014 (ADAMS Accession No. ML19228A241), SNC will proceed with selected activities outlined in Block 7 of the enclosure to the PAR 19-014 consistent with requested changes in LAR 19-014.

As required by License Condition 2.D.(1), the NRC has received LAR 19-014, referenced in PAR 19-014. The staff has evaluated LAR 19-014 and has determined that there is sufficient information to accept the LAR for detailed technical review in a letter dated September 11, 2019 (ADAMS Accession No. ML19319A011).

The NRC staff has determined that PAR 19-014 contained sufficient information on the impact of the proposed plant change on associated Inspections, Tests, Analyses, and Acceptance Criteria. In addition, the NRC staff reviewed the scope of the PAR and found that it is consistent with the changes from the current licensing basis as requested in LAR 19-014. Therefore, the NRC has no objection to SNC proceeding with the construction of the proposed plant changes identified in Block 7 of the enclosure to PAR 19-014, pending the outcome of the NRCs detailed technical review of LAR 19-014. NRC staff expects that if LAR 19-014 is denied, SNC will return the plant to its current licensing basis as required by License Condition 2.D.(1)(b).
