Dear Dr. Cochran:

This is in further response to Mr. Roisman's letter dated September 6, 1979, in which he requested, pursuant to the Freedom of Information Act, all documents prepared or received in connection with the preparation of NUREG-0459 and with the preparation of the upgraded physical protection regulations in 10 CFR Part 73.

The purpose of this letter is to explain the current status of our actions to respond to Mr. Roisman's request, and to clarify other information relative to the issuance of NUREG-0459.

When a Commission decision was made to undertake the generic adversary study, individuals involved in the study gathered information from various source documents concerned with the overall subject.

During the course of the study group's work, some documents reviewed were eliminated from consideration for various reasons, and their contents were not footnoted in the written work product of the study group.

The decision to include or reject information contained in each source document was left to the discretion of the study group members.

Ultimately, the text of the final report included specific references, by footnote, to source documents. The report, titled " GENERIC ADVERSARY CHARACTERISTICS, (U)", is classified SECRET. The report lists 141 documents which were

,specifically referenced. Of this number, six are NRC documents which are listed in Appendix A, and an additional 73 documents, listed in Appendix B, are open source materials and unclassified Government Agency Reports. These source documents are in addition to those previously identified to you.

This report is currently undergoing a declassification review, and you will be informed by letter of the results of that review.

Following issuance of the above SECRET report, it was decided that an unclassified version of the report would be prepared.

This unclassified report was subsequently distributed as NUREG-0459, " GENERIC ADVERSARY CHARACTERISTICS

SUMMARY

REPORT".

The text of NUREG-0459, except for the deletion of classified information, was derived directly from the above classified SECRET report.

i In our letter to you dated December 11, 1979, we provided you, as Enclosure 1, a list of 49 NRC documents, and as Enclosure 2, a list of 153 open source documents which we identified as having been used in preparing NUREG-0459.

In our letter we also referred to "650 documents". This "650" number in our letter was obtained from the PREFACE section of NUREG-0459 on page 11.

The number "650" inserted in the classified report and in NUREG-0459, therefore, was intended to explain the order of magnitude of documents reviewed rather than to define the specific number of documents which were specifically referenced in the study.

No listing or grouping of the "650" documents was maintained by the study group, and we are not able to identify those documents which were discarded.

In summary, we have now identified for you 55 NRC documents and 236 open source documents which are the unclassified source documents used in the preparation of the ganeric adversary study and indirectly in the preparation of NUREG-0459.

The remaining numerous classified documents identified in footnotes in the classified SECRET report: " GENERIC ADVERSARY CHARACTERISTICS (U)" are not listed, and a significant effort would be required in any attempt to conduct a declassification review of them.

In order to bring F0IA-79-371 to a satisfactory conclusion, please advise us if there is any specific topic of interest to you in NUREG-0459 in which you require further information.

This request includes, but is not limited to, all comments and recommendations of all NRC employees and consultants on the positions to be taken in the two identified documents and on the facts relevant to preparation of those documents.

With respect to any classified document, or any document referred to other agencies that are not made available to me within 10 days, e.g. due to a need for classification review, I request a record identifying the title, author, date and classification of these documents.
