This letter is to acknowledge receipt of your Inspection Report Number 50-440/

80-08, 50-441/80-08, attached to your letter dated June 4, 1980, which I re-ceived on June 6, 1980.

This report identifies areas examined by Mr. E. W. K. Lee during the inspection conducted May 6 through 9, 1980.

Attached to this letter is our response to the one (1) item of apparent non-compliance described in Appendix A, Notice of Violation. This response is in accordance with the prov;sions of Section 2.201 of the NRC's " Rules of Practice",

Part 2. Title 10, Code of Vederal F9gulations.

a RESPONSE TO ENFORCEMENT ITEM Below is our response to Appendix A, Notice of Violation, of United States Nuclear 3

Regulatory Commission IE Report 50-440/80-08; 50-441/80-08.

I.

A.

Infraction 10CFR50, Appendix B, Criterion IV, states, in part, that " Measures shall be established to assure that applicable regulatory requirements, design bases, and other requirements which are necessary to assure adequate quelity are suitably included or referenced in the documents for procurement of material, equipment, and services..."

Cleveland Electric Illuminating Company PSAR, Section 17, paragraph 17.1.4.1 states, in part, that " Procurement of safety class systems, structures, and components for the Perry Nuclear Power Plant shall be performed in accordance with written procedures. These procedures will require that procurement documents include quality requirements as well as technical requirements.

Requirements such as appropriate codes and standards, design bases, vendor quality assurance programs, purchaser access authority, and necessary documentation will be included."

Contrary to the above, on May 8,1980, the inspector established that Pullman Power Products Purchase Order No. 19-04-00-76-15 for welding material does not include the appropriate codes or standards.

B.

Response

1.

Pullman Power was requested to provide clarification of their Purchase Order No. 19-04-00-76-15 regarding the procurement of the weld material in compliance with GE Specification No. B50A533.

In a letter dated June 17, 1980, Pullman presented the following explanation:

a.

Items 64 and 10 are listed on the Purchase Order.

Item 64, the first item listed, is the E70S-6 material in question.

The CE specification applies to Item 10, the second item, the 3/32" diameter wire, and not the E70S-6 1/16" diameter which is in question.

Pullman purchased this 1/16" wire from "Raco" to chemistry requirements only.

Pullman then qualified the material to the complete requirements of ASME Section II Part "C" SFA5.18 by performing the required tensile and impact tests.

c.

Pullman further tested the electrode to satisfy the require-ments of Section III NB-2332 and Table NB2332-1 at a temper-ature of +30*F in both the welded and stress relieved condition.

The E70S-6 elcetrode passed and met all the requirements for the test conditions. The material test reports supporting this ex-planation were attached to Pullman's letter of explcnation.

As identified, ten (If pounds of this material was received at PNPP on August 9, 197's, and subsequently used on four (4) 48" diameter, 3/8" thick wall, ASME Section III, Class 3 pipe welds in the Plant Foundation.Underdrain (P72) System.

1 A review of ASME Section III material requirements for the P72 System found that the welding electt' ode was acceptable for use in the system. Therefore, no further corrective action is required.

3.

Full compliance with NRC requirements has been achieved.
