Dear Chairman Smith:

Pursuant to 10 C.F.R. 2.720 TMIA requests that you issue a subpoena to WOR-TV requiring it to provide a tape or transcript of the "What's Happening, America?" program. This program was broadcast between 8:00 and 9:00 p.m. on March 24, 1980.

In this program, Harold W. Hartman, a former TMI control room operator, was interviewed. This interview revealed facts pertaining to maintenance. practices at TMI which TMIA believes are relevant to its management contention.

TMIA informally requested this document previously. WOR-TV's reply requesting a subpoena is attached.

Therefore, TMIA requests that a subpoena be issued to:

Mr. Robert Fennimore, Vice President and General Manager, WOR-TV, 1440 Broadway, New York, New York, 10018, requiring a tape or transcript of the above described program be forwarded to TMIA as expeditiously as possible.
