Dear Members of the Board:

On June 27, 1980, the Union of Concerned Scientists filed a " Motion for Extension of Deadline for Filing Discovery of New Matters Raised in the SER." The Staff and the licensee agreed to the extension of time on the condition that the discovery requests would be hand-delivered on July 7, 1980. The Board granted UCS' Motion on July 3, 1980.

On the afternoon of July 8,1980, the Staff was handed a copy of " Union of Concerned Scientists Third Set of Interrogatories to the NRC Staff Based on New Information in the SER." Despite its late receipt of this discovery request, the Staff intends to respond to these UCS interrogatories._

However, the Staff will not provide copies of licensee documents to UCS as requested in interrogatories 2(f), 2(g), 5, 6, 8,10 and 11(a). These documents are available from the licensee.

Moreover, as UCS in its motion for an extension of deadline observed might happen if its request were to be granted, the Staff is not able to respond to the UCS interrogatories by July 21st.

Instead, the Staff intends to place a copy of its responses to the UCS interrogatories in the hands of counsel for UCS on July 28th. Counsel for UCS has stated that she has no objection to the modified arrangement for receipt of Staff responses. Copies of the Staff responses also will be delivered to the Board's offices in Bethesda, Maryland on July 28, 1980.
