NRC STAFF'S RESPONSE TO J. F. DOHERTY'S MOTION FOR FINANCIAL ASSISTANCE FROM NRC FUNDS THROUGH THE BOARD On June 27, 1980, Intervenor John F. Doherty, alleging indigence and citing a S moved that this Board "make available recent Comptr 11er General's opinion to him certain financial assistance" from " funds appropriated to the Comission by Congress." The financial assistance was requested to assist the Intervenor in the payment of copying, mailing and transcript costs and other related matters.

As a general proposition, this Board is presently precluded from authorizing 2/ n a recent decision dealing with the matter financial assistance to intervenors I

of financial assistance to intervenors the Commission considered the forementioned General Accounting Office decision referred to by Intervenor Doherty, along with other relevant matters,'and detennined that no financial assistance for intervenors was available, at least for FY 1980, which ends on September 30, 1980. -

However, with respect to that aspect of Intervenor Doherty's motion which relates to desired financial assistance for transcript costs and service costs, a forthcoming change in the NRC Rules of Practice,10 C.F.R. Part 2, will provide the requested relief.

On December 10, 1979, the Commission approved a pilot program which will provide (1) free copies of transcripts to intervenors in NRC proceedings, (2) free copies of certain other documents to intervenors, and (3) assistance to intervenors in the service of documents.

The put,.ication of an effective rule change in the Federal Register is insninent. When this rule change is published, a copy will be sent to Intervenor Doherty and all other parties to this proceeding for their guidance.

For the foregoing reasons, the Staff is of the view that the Licensing Board must deny Intervenor Doherty's motion.
