FERC Docket No. EL 79-8 Draft Transmission Service Settlement Agreement
Dear John:
I have reviewed the Draft Transmission Service Settlement Agreement dated July 2, 1980 which you sent to me.
The City of Austin finds the document to be unacceptable.

By the terms of the Agreement, Austin would have to file with FERC a tariff for wheeling if it charges over one mill and in two years would be bound by a tariff filed by Central Power & Light.
While the docL' ant states that it preserves Austin's exempt status, these provisions make Austin juris-dictional as a practical matter for wheeling.
Austin does not agree that FERC can obtain jurisdiction over all utilities in Texas for wheeling for all purposes merely as the result of a direct current tie.
FERC'c jurisdiction is limited to the tie and not beyond.
Austin cannot by agreement, even if it so desired, grant FERC jurisdiction over it.
Further, Austin does not believe that a " postage stamp" wheeling rate is proper in Texas where the distances are so great from one system to another.
Austin is ready and willing to sit down with you and any other federal agency or party to t is and related proceedings to work out an agreement.
However, to date, this method has not been implemented by NRC, FERC, Justice or other parties to the pro-ceedings.
