Dear Mr. Prospect:

In your letter of May 20, 1980, you requested that representatives of the Nuclear Regulatory Comission (NRC) attend a meeting of the Suffolk County Legislature on May 28, 1980.

In response to a previous request, dated April 7,1980, we verbally agreed to a one-time appearance before the Health Comittee on May 19, 1980, and we provided the following technical members of the NRC staff:

Investigative Specialist Charles 0. Gallina James C. Higgins Resident Inspector Lewis Narrow Reactor Inspector Emergency Planning John R. Sears Jerry N. Wilson Licensing Manager At the completion of questioning by the Comittee, the Chairman stated that the Health Committee might have questions on the investigation of alleged construction deficiencies at the Shoreham Nuclear Power Station. The Chairman asked that Mr. Gallina appear before the Health Comittee on May 28, 1980.

Mr. Gallina agreed to this request and he did in fact appear on the requested date.

During a telephone conversation with Mr. Wilson, subsequent to the May 19th meeting, you requested that Mr. Sears and Mr. Wilson also attend the May 28, 1980 meeting. Mr. Wilson advised you that he and Mr. Sears would not be able to attend.

I assure you that we will continue to be responsive *.o future requests from Suffolk Cou7ty for information on our review of the Shoreham application.

However, because of tight fiscal resource limitations and other high priority work, it may not always be possible to accomodate requests for attendance at comittee meetings.

Sir:

s On May 19, 1080, the Health Committee of the Suffolk County Legislature heard testimony from the NRC represented by Mr. Jerry Wilson, Mr. John Sears, and Dr. Gallina. At that time the Health Committee publicly invited them to come back for the final hearing to be held on May 28, 1980.

Mr. Wilson and his colleagues aqreed.

At this date, the NRC is reneging on that agreement.

The people of Suf folk County hope that the NRC will honor their commitment.
