MOTION OF THE DEPARTMENT OF JUSTICE TO RENEW ITS MOTION TO ESTABLISH A TRIAL DATE AND OTHER PROCEDURAL DATES Pursuant to the Atomic Safety and Licensing Board's

(" Licensing Board") June 13, 1980 Order Extending Time, and Notice of Prehearing Conference (" Order"), the Department of Justice (" Department") hereby renews its May 21, 1980 Motion to Establish a Trial Date and Other Procedural Dates in order to facilitate final pre-trial preparation the above-captioned pro-ceedings.

On May 21, 1980, the Department submitted its Motion to the Licensing Board to establish a trial date and other proce-dural dates.

On June 13, 1980, the Licensing Board issued an Order which denied this motion after the filing of the Set-t1ement Status Reports on July 11, 1980, but gran',ed the De-

.partment leave to renew its motion.

Since the issuance of the Licensing Board's Order, the De-8007160547-

partment has again attempted to reach a basis for 6.he potential settlement of these proceedings.

As reported in the Depart-ment's July 11,.1980 Settlement Status Report, however, set-tiement does not appear to be possible at this time.

There-fore, the Department contends that a trial date and other pro-cedural dates should be established so that final trial preparation can be accomplished.

Further extensions of the schedule to allow for additional settlement negotiations, without establishing a trial date, will only have the effect of foresta111ng final resolution of the issues in these proceedings.

Accordingly, the Department submits that a trial date and other procedural dates be established as follows:

September 8, 1980 Filing of Witness Lists, Concise Summaries of Tes-timony, initialed exhibits, trial briefs by Department and other complaining par-ties.

Sepbember 22, 1980 Filing of Witness Lists, Concise Summaries of Tes-timony, initialed exhibits, trial briefs by TUGCO, HL&P, and other responding parties.

September 29, 1980 Final Prehearing Conference pursuant to 10'C.F.R.

52.752.

October 6, 1980 Commencement of Evidentiary Hearing.

Wherefore, the Department respectfully requests the Licen-

. sing Board adopt the foregoing schedule for a trial date and

other procedural dates.
