NRC STAFF RESPONSE TO PETITION FOR LEAVE TO PARTICIPATE AS AN INTERESTED STATE FILED BY THE NEW YORK STATE ENERGY OFFICE On May 28, 1980, the Commission issued a Notice of Proposed Issuance of Amendment to Facility Operating License. 45 Fed. Reg. 35948. The subject of the notice was the application of the Consolidated Edison Company of New York, Inc., for an amendment to its operating license for the Indian Point Station, Unit No. 2, located at Buchanan, New York, which would allow expansion of spent fuel storage capacity at that facility.
In the Notice it was stated that petitions for leave to intervene were to be filed by June 27, 1980.

On June 25,-1980, a timely petition was filed by the New York State Energy i
Office for leave to' participate as an interested state under 10 C.F.R. 5 2.715(c) of the Commission's regulations.
This petition specifically stated that it was not to be construed as a request for a hearing.
Petition for Leave to' Participate as an-Interested State by the New York State Energy Office at 2.
No petitions for leave to intervene were filed by any person under 10 C.F.R. 5 2.714.

Since no petitions to intervene and no request for hearing have been filed and the time for.such filing has passed, there is no proceeding pending in which the New York State Energy Office could participate as an interested state. However, if such petitions for leave to intervene were to be filed in the future and were to be granted, the Staff-would have no objection to the participation of the New York State Energy Office as an interested state in accordance with {0 C.F.R. 5 2.715(c) of the Commission's regulations.
