SCHEDULE FOR PROPOSED RULEMAKING ON REACTOR SITING
Purpose:
To modify the schedule for rulemaking to reflect consideration of staff resource priorities and to make better use of feedback from ongoing staff activities for existing sites.
Discussion:
SECY-80-153, dated March 19, 1980, contained a proposed schedule for staff siting rulemaking activities.
That schedule, keyed to issuance of an advance notice of proposed rulemaking in April 1980 and completion of technical support work by July,1980 indicated issuance of a proposed rule in November,1980.
This accelerated schedule was proposed in anticipation that forthcoming legislation would require that the Commission develop revised siting regulations on a six to nine month schedule from the date of enactment of the bill.
In addition, key staff members needed to direct the technical activity leading to specific siting criteria were assigned to higher priority tasks. These factors, as well as direction received from the Commission on the proposed Advance Notice, all indicate the need for entering this

particular rulemaking with greater deliberation.
Following preparation of SECY-80-153, the staff has been assessing the scope of work which will be required to support criteria identified in the Advance Notice as well as the analyses of alternatives which will be required in the Environmental Impact Statement.
These assessments indicate that a more realistic rulemaking schedule would make it possible to develop stronger technical support, including evaluation of alternatives. A more realistic rulemaking schedule would allow better coordination with ongoing closely related activities on current site licensing decisions such as the Indian Point and Zion studies and NEPA analysis of accidents, the RES Interim

Reliability Evaluation Program (IREP) as well as the rulemakings on Degraded Core Cooling and Emergency Planning. All these activities are identified as priority 2 in the TMI Task Action Plan, which is consistent with a more realistic schedule for the rulemaking on siting.
The House-Senate Conference Report No. 96-1070 on the FY 1980 Authorization states that the regulation be applied only to plants which file an application for a construction permit after October 1,1979.
It also has no requirement for issuing a proposed rule on demographic criteria by a specific date.
It is our understanding that the underlying intent of the Conference Committee in the Joint Explanatory Statement of the Committee on Conference on Section 108 of S.562, is that the NRC proceed with the best possible schedule on this rulemaking. The revised schedule is compatible with our understanding of the underlying intent of the Conference Committee.
Enclosed is a replacement for Enclosure B to SECY-80-153, which is the revised schedule for this rulemaking. This revision indicates that a proposed rule would be issued in April 1981, a Draft EIS issued in October 1981, and a final rule with a Final EIS in June 1982.
Coordination:
This paper has been concurred in by the Office of Nuclear Reactor Regulation and the Office of Nuclear Regulatory Research. The Office of Executive Legal Director has no legal objection.
