On August 1, :979, a prehearing conference was held in this proceeding pursuant to Order of this Board released July 3, 1979.

Attending the prehearing conference were counsel for the Licensee, Sacramento Municipal Utility District, counsel for the Staff of the Nuciear Regulatory Commission, counsel for Friends of the Earth, Environmental Council of Sacramento and the Original SMUD Ratepayers Association, Mr. Gary Hursh, and counsel for the California Energy Commission.

On the basis of the amended petitions'and contentions sub-mitted j ointly by Friends of the Earth, Envs.ronmental Council of Sacramento, Original SMUD Ratepayers Association, and submitted

-jointly by Mr. Gary Hursh and Mr. Richard D.

Castro, and upon oral argument, the Board finds that all of these petitioners have mec the. personal interest requirements and have stated at least-one contention pursuant to 10 CFR 52.714, to accord them intervention as parties-to this proceeding.

, The _ Board also finds that the California Energy Commission, as, a1 representative of the State. of California, is granted interested state ' status under 10 CFR 52.715 (c).

~At the prehearing conference, the Board (a) directed that all parties, including the California Energy Commission, meet and confer regarding possible stipulation of contentions in this proceeding, and submit to the Board no later than August 20, 1979, a proposed-stipulation concerning agreed upon con-tentions, and a statement of contentions on which agreement cannot.be reached; (b) directed all parties, including the California Energy _ Commission, to. submit to the Board no later l

than August-27, 1979, briefs on the scope of this Board's. jurisdiction in this proceeding.

In their briefs, the parties were requested to address the effect, if any, of a commission rulemaking, either in program or planned, on the admissibility of any contentions; (c) ordered that the burden of proof on all conter.tions will be placed upon the licensee and the burdan cf going forward en contentions _shall be placed upon the party making the contention; u
