This is in response to your letter of October 17, 1970, to Mr. A. A.
Wells, Chairu.an, Atv.r'c Safety and Licensing board ranc1, requesting a 90-day extension of the ccrament period in vnich to preparc co= cents on the Toledo Edison Company's environmental report on the Davia-Lesse
- ucicar rover Plant.
As the rederal nerf ster notice for the plant indicated, and as provided fu section 102(2)(C) of the National Environmental Policy Act, coments on the report were requested from appro;>riate State and loeni agencies "which are authorized to develop and enforce environmental standards."
It is not apparent from your letter that you represent a State or local agency, and it vould be inappropriate, therefore, to grant an extcasion of the cc:nent period at this time. Tor your infor=ation, I am enclosing a copy of a letter received from the Ohio Department of licalth which indicates that it is the Depart:ent desipated by the Governor as respon-uf ble for preparing Ohio's comments on environcental reports.
In his letter, Dr. E. V. Arnold, Director of licalth, endorses the issuance of a construction permit for the proposed Davis-Ecsse plant and concludes that there appears to be reasonable assurance that the proposed facility can be constructed and operated without unduc risk to the health and safety of Ohio's citizens.
As provided in our policy states.ent (copy enclosed), af ter ve have received the com=ents of the appropriate Federal, State, and local agencies, we will prepara a detailed environmental statement including, where appropriate, a discussion of any cozacnts or objections raised and the disposition thereof. Copics of the stater ent will be forwarded to the Council on Environ = ental Quality and to the agencies concerned, and will accompany the application through the Con =ission's review proccon, including the public hearing. We vill be pleased to send you a copy of our environmental s;ateaant when it is prepared, probably within tne next f'ev veeks.
