MOTION OF THC DEPARTIENT OF JUSTICE FOR AN ORDER COMPELLING THE 2RODUCTION OF DOCUMENTS BY THE CLEVELAND ELECTRIC ILLUMINATING COMPItNY Pursuant to Rule 2.740 (f) of the'Ccmmission's Rules of Practice (10 C.F.R. S2.740(f)) and the amended order of this Hearing Board issued November 19, 1975, the Department of Justice hereby moves this Hearing Board to issue an order requiring pro-duction of the documents sought by " Request of the Department of Justice For Production of Documents By Applicant The Cleveland Electric Illuminating Company," should Applicants fail to pro-duce these documents or object to their production on November 25, 1975.
The Department hereby incorporates by reference those legal arguments and statements concerning relevance of the documents 6h 8002 200 g

sought and absence of burden on Applicants which are contained in the " Application of the Department of Justice for a Subpoena to The Cleveland Electric Illuminating Company," dated October 31, 1975.
The Department notes that The Cleveland Electr'c Illuminating Company ("CEI") has filed suit in the United States District Court for the District of Columbia against various representatives of the Department of Justice. 1/
IThe issues raised by CEI in that proceeding are (1) whether the Department of Justice issued Civil Investigative Demand No.
1629 to CEI in bad faith and in an attempt to circumvent limita-tions upon discovery imposed in this consolidated proceeding, and (2) whether the Department may properly utilize knowledge of the existence of documents obtained pursuant to the provisiens of the Antitrust Civil Process Act (15 U.S.C. Sections 1311-14) in order to obtain production of such materials pursuant to separate process in a proceeding before the Nuclear Regulatory Commission. 2/

CEI's " Petition to Reatire the Performance of Duty by an Antitrust Document Cust-dian, for a Protective Order and for Injunctive and Other Relief" initiated the District Court pro-ceeding captioned CEI v. Charno, et al._ (Civil Action 75-1914).
This pleading was annexed to Applicants' " Motion of The Cleveland Electric Illuminating Company to Quash Subpoena Issued At The Request Of The Department of. Justice," dated November 15, 1975.
2/ ' In order not to prejudice CEI's right to adjudication by the District Court of the issues raised in its petition there, the Depart-ment will make no attempt to introduce into evidence in this proceed-ing any documents secured pursuant to the order sought herein until-the District Court rules on CEI's motion for preliminary injunction.
