The Cleveland Electric Illuminating Company, et al. (Perry Plant, Units 1 and 2)
Dear Mr. Goldberg:
The Appeal Board assigned to the above-entitled matter will enpect the City of Cleveland's brief in support of its pending appeal to address the question of the Board's jurisdiction to entertain the appeal.
This question arises in view of the provision in Section 2.730(f) of the Conmissien's Rules of Practice,
10 CFR 2. 7 3 0 (f ), to the effect that "[nlo interlocutory appeal may be taken to the Commission from a ruling of the presiding officer [i.e., Licensing Boardl ".
Since the Appeal Board acts as the delegate of the Commission, this prohibition serves as a limitation upon its jurisdiction.
