ORDER PROVIDING FOR EXCHANGE OF DATA UNDERLYING CONCLUSIONARY TESTIMONY OF EXPERT WITNESSES By this order, we provide for the exchange of the studies and other underlying data upon which conclusionary testimony of expert witnesses is based when such data is required for cross-examination.
At the Seventh Prehearing Conference, all parties agreed in principle to the exchange of data but not to the timing.
The Board sees no prejudice to any party in simultaneous exchanges and considers the avoidance of surprise as the controlling consideration.
The immediate exchange of all underlying data would be preferable, but an order requiring i= mediate exchanges might be unduly burdensome because it could-require the production of data not needed by the adverse party.
Therefore, the following procedure will be followed in the exchange of data underlying conclusionary expert testimony.

. On or before November 24, 1975, a representative of counsel for Applicants and a representative of counsel for the parties adverse to Applicants shall request the appropriate parties tc provide desired underlying data referred to in the direct written testimony of expert witnesses.
Requested data shall be specifically described and such request shall be con-sidered a professional representation that the requested data is thought to be required for cross-examination and that the requested party does not possess or have practical access to or, in the case of documents previously made available, identification of such data.
Objections, with reasons therefore, to providing any requested data shall be made to the Board on or before November 28, 1975.
On or before December 9, 1975, unless a delay has been granted by the Board, the party sponsoring the expert witness shall deliver the related underlying data to requesting counsel (or identify previously supplied data), or if physical delivery is unreasonably burdensome, the sponsoring party shall provide an opportunity for inspection or other practical and convenient access.
Motions to compel access to underlying data shall be made within five (5) days of any alleged failure to exchange data.
