STAFF'S ANSWER IN OPPOSITION TO CITY OF CLEVELAND'S NOTICE OF APPEAL AND EXCEPTIONS The City of Cleveland (City) on July 28, 1975 filed with the Appeal Board the captioned Notice for the purpose of appealing the June 19, 1975 Order of the Special Master herein and the Licensing Board's Order of July 21,1975 that denied City's motion to certify the Order of the Special Master.
Staff is opposed to the City's interlocutury appeal because such a procedure is clearly prohibited by the Commission's Rules of Practice.
Section 2.730(f) states that:
"No interlocutory appeal may be taken to the Comission from a ruling of the presiding officer....
In interpreting Section 2.730(f) the Appeal Board in Philadelphie Electric Company (Fulton Generatir.g Station, Units 1 & 2), ALAB 206, 7 AEC 841 (1974) and cases cited therein stated that the Commission's Rules of Practice clearly prohibits the type of appeal contemplated by the City of Cleveland.
