MOTION FOR CLARIFICATION AND IN THE ALTERNATIVE FOR THE ESTABLISHMENT OF A DATE CERTAIN FOR RESPONSE TO MOTION FOR

SUMMARY

DISPOSITION On August 15, 1974, Applicants filed their Motion for Summary Disposition pursuant to Section 2. 749 of the Commission's Rules of Practice. The City of Cleveland (Cleveland) opposes Applicants' motion and moves fo r clarification of the date for response or in the alternative for an extension of time in which to respond.

1 Applicants have taken the position that the response of intervenors and the Department of Justice is governed by Section 2. 730 of the

' Commission's Rules and thus is due in 5 days. Section 2. 730 applies generally to motions. Section 2.749 applies specifically to Motions for l

Summary Disposition and provides that replies may be filed "at lea:,t two (2) days before the date of the hearing. " Cleveland believes that the specific provisions of Section 2.749 and not the general provisions of Q ;{ )%AwY l

Section 2. 730 must rule the time for response. In that event responses may be filed up to May 12, 1975.

Cleveland also notes that this Board's Frehearing Conference Order No. 2 establishes final dates for various procedural events. April 14, 1975 is established as the final date for filing responses to Motions for Summary Dispo sition. To the extent that the Board can alter the dates set by Section

2. 749, April 14,1975 is the day for filing responses to Applicants' Motion.

Should the Board determine that neither April 15, 1975 nor May 12, 1975 are the proper dates for response, Cleveland requests that a date certain for responding to Applicants' motion be set by the Board no earlier than September 30, 1974. In this regard, Cleveland notes that counsel for the intervenors, Commission Staff and the Department of Justice are pre-sently engaged in preparing discovery requests and are conferring to determine the extent to which a joint discovery request can be formulated for the greater convenience of the Board and the Applicants.

Cleveland is authorized to state that the Department of Justice joins in this motion.
