In compliance with the Licensing Board's strin-

-gent time requirements, CEI hereby objects to the aforesaid document request of the Department of Justice and states that it does not intend to comply with this unreasonable demand of the Department for additional discovery material.

CEI's reasons for taking this position are spelled,out in part in its motion to quash the October 31 subpoena of the Department.

In view of the fact that the Department has now elected to proceed pursuant to Section 2.741 of the Commission's Rules, having been unsuccessful in its attempt to invoke the sub-poena powers of this Licensing Board under Section 2.720 of the Commission's Rules, there are additional considerations which this Licensing Board must also take into account in ruling on the question before it.

CEI will submit a memorandum discussing those additional considerations in response to the Motion of the Department for an order compelling production of the afore-said documents-(which Motion was also filed on November 21, 1975).

In accordance with the extremely tight time schedule handed down by this Licensing Board on November 20, 1975, that response will be filed on December 2, 1975.
