APPLICANTS' REPLY TO MOTION OF THE CITY OF CLEVELAND TO LIMIT APPLICANTS TO A SINGLE PREHEARING BRIEF In a me~~ aated November 20, 1975, the City of Cleveland (Ci._ makes reference to a " solemn agreement" to file a single prehearing brief in order to preclude Ohio Edison Company and presumably other Applicante from submitting separate prehearing briefs in the above-captioned proceeding.

1 Applicants object to the motion by the City and respect-fully urge the Licensing Board to deny it. The agreement dated March 28, 1974, with regard to procedures to be followed in the I

consolidated Davis-Besse and Perry proceedings was agreed upon l prior to the inclusion of the Davis-Besse Units 2 and 3 facilities I in these proceedings. Those facilities were included following the Department of Justice Advice Letter which was issued eleven months subsequent to the March 28, 1974, agreement.

In additien, the March 28, 1974, agreement was executed 18 months prior to the receipt of the detailed allegations by the other parties on September 5, 1975. In the Department of Justice Advice Letter on Davis-Besse Units 2 and 3 and in the September 5, 1975, filing of allegations by the parties, the Applicants learned of many allegations made for the first time against the applicants other than The Cleveland Electric Illumin-ating Company.

As a result of these new developments, it would be un-reasonable to limit the several Applicants to the filing of a single prehearing brief if they choose to otherwise inform the i

Licensing Board and the other parties to this proceeding of the cases to be made by the individual Applicants in reply to the allegations now being made against them.
