AMENDMENT TO MEMORANDUM AND ORDER OF THE BOARD GRANTING MOTION OF CEI TO QUASH SUBPOENA On November 18, 1975, following a telephone conference call among affected parties, the Board issued its Memorandum and Order Granting the' Motion of Cleveland Electric Illuminating Co.

(CEI) to Quash a Subpoena issued by the Board at the behest of the Department of Justice (Justice).

In its Memorandum and Order, the Board granted Justice leave to apply for production of the subpoenaed documents under Section 2.741 of the Commission's Rules.

In ordinary circumstances, Section 2.741(d) would allow CEI 30 days within which to comply with the request or otherwise object.

Section 2.740(.f) then would permit the filing of a Motion to Compel Discovery within five days after the response date.

Pursuant to Section 2.718 and Section 2.730 of the

. Commission's Rules, we hereby direct Applicants to respond to the production request or objection no later than November 25, 1975.'

Because Applicants have set forth in substantial detail their~

position with respect to why the Board should deny any request for the production of these documents, it is rot necessary for Applicants to brief these questions further in connection with any objections or response pleadings to a Motion t, Compel Discovery which they may file.

The Board will accept the brief and memorandum filed in connection with the Motion to Quash Sub-poena as relevant to the issue of production of the same documents under Section 2.741.*

Because Applicants have made clear their position that delivery of these documents should not be ordered and since Appli-cants have indicated their intent not to produce the documents

except upon resolution of the issues posed in its opposition, we grant Justice authority to file a Motion to Compel Discovery for documents not produced by November 25, 1975 contemporaneously with its Motion for Production of Documents.

Because the Board has been appraised of the Justice position on the legal merits of this issue, it is not necessary for Justice to file additional briefs.

Applicants may have until December 2, 1975 to respond to the Justice Motion to Compel Production.

As indicated in our Memorandum and Order of November 18, we granted leave to either party to this dispute to file such addi-

.tional brief going to the merits of the controversy as may be desired, but we indicated that the Board would not withhold consideration of the issue in anticipation of r.eceiving additional briefs.

- f The schedule amendments Are being made so that we can resolve this controversy at the earliest opportunity.

Both parties have presented full argument to the Board with respect to the merits of the underlying issue.

Additionally, we note that in the. event production were to be ordered,* no burden.would be associated with physical production.

No file search would be involved since the documents have been listed and indeed already are segregated physically.

Justice is in a position to deliver the documents sought to Applicants for retransmittal to Justice in the event the Board decides production is appropriate.

Finally, with respect to any amendment of ordinary time schedules, we note that Applicants have been appris.ed of Justic'e's intent to obtain produc-tion of these documents, via subpoena or otherwise, for a period of several weeks.
