MOTION OF THE CITY OF CLEVELAND TO LIMIT APPLICANTS TO A SINGLE PREHEARING BRIEF During a confe'rence call on November 14, 1975, the City of Cleve-

-land (Cleveland) learned for the first time that Ohio Edison Company intended to submit a prehearing brief of approximately 75 pages in addition to the prehearing brief of approximately 200 pages to be fD.ed by Applicants jointly.

Cleveland moves to require Applicants to file a single joint prehearing brief.

Pursuant to the Board's Memorandum and Order filed on March 15, 1974, the parties met un March 28, 1974', to agree on procedures to be followed in the consolidated Davis-Besse and Perry proceedings. During the course of that meeting the parties agreed:N If Statement On Consolidation Procedures, dated March 29, 1974 and signed by Mr. Charnoff for the Applicants.

5. The parties also agree that a single Prehearing Brief will be filed by each Intervenor, the Reg-ulatory Staff, the Department of Justice, and the Applicants. . . .

The mere fact that Ohio Edison Company has now retained its own counsel in these proceedings should no.: provide an excuse for Applicants to depart from their solemn agreement to file a single prehearing brief.

WHEREFORE, Cleveland prays that the Board enter its order re-quiring Applicants to file a single prehearing brief.
