MOTION FOR EXTENSION OF TIME t

l Pursuant to Rule 2.730 of Commission's Rules of Practice i

I (10 C.F.R. S2.730), the Department hereby moves the Licensing Board to allow the parties in this proceeding until September 12, 1975, to reply to " Applicants ' Renewed Motion For Summary Disposi-tion."

The Department notes that Applicants are reiterating for the fifth time in this proceeding arguments concerning nexus which have been uniformly rejected by the Licensing Board.

If there is any conceivable merit to Applicants' raising taese L

questions again, clearly the timing of the motion can only serve b

to further delay this proceeding.

At this time, all parties, except Applicants, are engaged in attempting to prepare statements of ultimate issues which are due to be' filed on September 5, 1975.

i It is impossible for the Department to meet this prcedural dead-j line if it must, in addition to preparing the statement of issues and attending to the other matters in this proceeding which require its attention, prepare a fif th brief in response to the Applicants' j

arguments in the five days specified in the Commission's Rules.

For these reasons, the Department requests the Licensing Board t

to extend the time for reply to Applicants' most recent filing I
