I ORDER OF BOARD WITH RESPECT TO DEPARTMENT OF JUSTICE MOTION OF APRIL 23, 1975 FOR FURTHER DOCUMENT PRODUCTION By Motion of April 23, 1975, the Department of Justice moved the Board to require each deposing party to produce to counsel for other parties copies of documents expected to be utilized during the course of depositions.

Applicants' reply to this motion was served on April 28, 1975.

The Board has considered the Motion and the Reply and rules as follows.

(1)

All documents (other than documents utilized solely for impeachment purposes) which are expected to be utilized in connection with the deposition of a witness must be designated at least 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br /> prior to commencement of the deposition.

(2)

Subject to paragraph (1) above, if (a) the deposition is to be conducted in Washington, D. C. or at the agreed upon site of any other central document depository the parties may chcose to 8.002180

. establish, and (b) the designated document (s) is (are) available and subject to prompt location within the Washington, D, C. or other document depository, no copy need be produced by the deposing party.

If the conditions set forth in paragraph (2) above do not apply, the party designating a document (s) must offer to make available a copy or copies of each designated document to any other party at a reasonable and minimum reproduction cost,* such copy (copies) are to be available no later than 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br /> prior to use during the deposition.

If a designated document consists of a lengthy **

study, analysis, schedule, memorandum, tariff, etc., the deposing party shall designate with particularity the page or pages which will be the subject of possible examination.

(5)

It is the intent of the Board to have discovery proceed expeditiously and without unreasonable delay occasioned by the need to give counsel for non-deposing parties an opportunity to examine documents.

Accordingly, all counsel are directed to cooperate in insuring that depositions do not take place in an atmosphere of surprise and that all counsel have ample advance access to deposition documents.

Without receiving evidence on what constitutes reasonable cost, the Board would expect such costs to be less than S.04 per page.

Ten or more pages.
