Dear Mr. Stolz:

As discussed between Mr. Leon Engle, NRC Licensing Project Manager for Davis-Besse Unit 1, and Mr. E. C. Novak, Toledo Edison Company, General Superintendent, Power Engineering and Construction, this letter is to identify an exception which the Applicant desires to take regarding the f requency of performing the Functional Check as presently required by the Davis-Besse Technical Specification 4.3.2.1.1.

This Technical Specification deals with the steam generator level switchee which are part of the Steam and Feedwater Rupture Control System (SFRCS).

The 1971 edition of IEEE-279, Section 4.9, requires that the capability for sensor checks during reactor operation be provided.

Since the steam generator level switches do not have the capability for sensor checks during operation, these switches are being replaced with steam generator level transmitters and remotely installed bistables which are capable of sensor checks during operation, and are scheduled to be installed in June 1977. During the intarim period from fuel load until the steam generator level transmitters are installed, the Functional Check frequency of the steam generator level switches will be once every 90 days as indiceted on Page 7-38b(1) of the Davis-Besse Nuclear Power Station Unit 1 FSAR, Revision 24.

Davis-Besse Technical Specification 4.3.2.1.1 presently requires that the Functional Check of the steam generator level swf uches be performed on a monthly basis. Because of the location of these switches within the secondary shield wall within the containment vessel, this Technical Specification would require shutting down Davis-Besse Unit 1 on a monthly basis.

, B'ecause of the historically low probability of failure of these switches, along with the redundancy provided in the system (more than one of these switches would have to fail to result in the system not performing its intended function), we believe that performance of the Funct.ional Check on a quarterly basis rather than a monthly basis during this interim period will not result in any undue safety risk. Therefore, we are requesting that an exemption to Technical Specification 4.3.2.1.1 be given to allow the steam generator level switches to be functionally checked on a quarterly basis until the steam generator level transmitters and remote bistables are operational.
