MOTION FOR LEAVE TO FILE OVERSIZE 3RIEF IN SUPPORT OF PETITION FOR REREARING Now come petitioners and state as follows:

1.

Petitioner previously filed a motion requesting an expedited hearing in this =atter.

Petitioners had anticipated filing a brief at such time as the Court fixed the requested hearing and a briefing schedule.

2. ' Lengthy briefs have been filed in this =atter by respondent NRC and applicant intervenor.

3.

The Court ruled on pctitioners' filings without first setting hearing, a briefing schedule or otherwise hearing argn=ent on behalf of petitioners. The nature of the Court's rulings are of such a nature as to determine this =atter adversly to petitioners.

Petitioners' brief in support of Petitioner for Rehearing before this Court of Appeals is effectively Petitioners' first opportunity n

to set forth an argn= ant in support of their right to a 30 day notice of an NRC license anendment and to injunctive relief.

Petitioners have nade every effort to keep their supporting brief within the 10 page limit for Petitions.

Wherefore, petitioners nove for leave to file an oversize brief in support of Petition for Rehearing in accordance with Rule 40 of the Federal Rules of Appellate Procedure and Rule 14(a)(2) of the rules of this Court for the foregoing extraordinary and compelling reason.
