CHAIRMAN AHEARNE:

The Commission this morning --

3 first I would like to hold -- vote to hold a short notice 4

meeting in order to address an order on a motion for recon-5 sideration of 80-25.

All in favor of holding a short notice 6

meeting.

7 I j

(A chorus of ayes) 8 CHAIRMAN AHEARNE:

Len.

9 MR. BICKWIT:

You have an order that was distribu-a 4

10 '

ted to you.

There are some modifications that some offices ig 11 l have suggested.

I think you are familiar with those.

As

!!j.12 far as we are concerned, either order is acceptable.

If you s'.

13 want to vote out either of them we would be. delighted, e,

5 l 14 CHAIRMAN AHEARNE:

ITny don't we just vote the order 3 ' 15

=

that we have printed in front of us?

5 16 MR. EILPERIN:

With the one modification on page 6.

9 E

17 That the last paragraph will begin by reading with regard to 18 venting itself, the unmodified technical specifications which '

f.'19 allowed the venting were adopted as part of the licensing

=

20 proceeding of TMI-2 af ter full opportunity for a public 21 hearing.

That was previously discussed with you.

' 22 COMMISSIONER GILINSKY:

Did I understand what these 4

23 ' modifications were?

lr$ 24 MR. EILPERIN:

The other modification was also on 25 page 6.

The top of it reads -- dealing with psychological

.t OER $CN RE. OR-*NG COMPANY. ;NC.

3 1

stress the top reads we remain confident, however, that stress 2

is likely to be minimized by proceeding promptly with a plan 3

that poses no threat to physical health.

4 We had a change suggested by Comissioner Bradford's j

5 office.

7 6

CONMISSIO1iER KENNEDY:

Is this a change in his 3

7' opinion or in the majority!s opinion?

8 MR. EILPERIN:

This is only one order before the g

E 9' Commission, so it would be a change in the Commission's order.

a 4

10 '

COMMISSIONER KENNEDY:

To which he dissents?

l ig 11 '

MR. EILPERIN:

No, he has not indicated a dissent.

j.12 i The change suggested by Commissioner Bradford would be to pick 5

13 up wording which had been used in the Commission's June 12,

=i 5 l 14 1980 order.

And his suggestion would be we remain confident, 1

3 15 however, that stress will be lessened one, by our having n

g 16 chosen a plan which rests on the very wide consensus that 9

E 17 physical health is not threatened by the krypton release.

, 18 Two, by having the krypton release occur in the shortest

$ ' 19 time consistent with public health and s fety.

And three, by C

[

20, a clear step toward cleaning up other potential sources of i:;

21 radiation damage to the reactor.

We think that either version

', 22 of this last change is certainly acceptable with the Office

.% 23 'of General Counsel.

And whichever changes the Commission 24 majority we would f avor.

25 C0ltiISSIONER KENNEDY:

I vote for the order as it I.;,,,::G4cN ?.E. CFC*NG c::MP ANY. (NC.

was given to us with a minor editorial change or two made.

2 The one suggestion you just made now seems to me to offer 3

nothing and I don't see any sense in changing orders at the 4

last minute for no purpose.

{

5 COMMISSIONER GILINSKY:

Let me be very frank with h6 you.

I have not worked with this Order.

I expected to come j

7 in later.

I thought it would he handled by other Commissioner 3.

8 When is Peter coming in?

Do you know?

9 MR. EILPERIN:

I don't know.

We can go through the a

d l

4 10 Order if you wish.

We have time constraints.

=g 11 '

COMMISSIGNER GILINSKY:

I understand.

Let me put it

)!

j 12 i this way.

I have not looked at it myself and I'd rather not E

13 :

if it's be in a position of approving socething I haven't

=,

i 5 i 14 possible --

r' 3

15 MR. BICKWIT:

'You could abstain if you want to do g

16 that.

E W

17 COMMISSICNER GILINSKY:

I'll do that.

, 18 CHAIRMAN AHEARNE:

He'll do that.

I'll vote aye.

f

  • 19 CO'eIISSIONER KENNEDY:

Aye.

20 MR. BICKWIT:

Fine.
