SUBJECT:
ADMINISTRATIVE CONFERENCE SURVEY QUESTIONNAIRE ON CIVIL PENALTIES The Commission has received a survey questionnaire from the Administrative Conference of the United States reEarding "the procedures used to mitigate, remit or compromise civil Jaoney penalties.."
(copy attached).
The Com:sission has directed OGC to coordinate a reply and has asked for a draft response by February 13, 1978.
Most of the questions c*all for information which I believe I&E is in the best position to provide, such as the specific procedures used to assess and to mitigate penalties and the details of agency experience with these procedures.
There-fore I would appreciate it if you would arrange for prepara-tion of a draft response'to this questionnaire for forward-irs to OGC by Thursday, February 9,1978.
OGC will draft ansvers to question 2a, b,d, e; 3, 9, 10 and 14.
I&E should prepare responses to the other questions.
OGC will provide assistance with legal matters and will put the response in final form for presentation to the Commission.

Please.have your office notify Mr. Slaggie promptly if you anticipate any dir,ficulties in carrying out this request.
