SUBJECT:

COMPLETION OF URANIUM REC 0VERY LICENSING BRANCH REVIEW 0F PROPOSED NOSE ROCK URANIUM MILL PROJECT OF PHILLIPS URANIUM CORPORATION The subject mill was proposed for construction in the State of New Mexico and a Uranium Recovery Licensing Branch (WMUR) environmental and tailings management review was conducted in response to a technical assistance request from the State of New Mexico (letter, G. Stewart to R. Scarano, dated December 1, 1978).

WMUR review has specifically consisted of the following:

1.

Review of the Phillips environmental reptet and associated supporting

'N documents.

A site visit by WMUR staff and consultants and a meeting between Phillips, New Mexico, and WMUR to discuss WMUR technical questions andconcerns(January 16,1979).

Discussions concerning the proposed project are documented by the WMUR staff in meeting minutes dated January 30, 1979.

3.

Preparation of a letter report to the State of New Mexico (letter, R. Scarano to T. Wolff dated February 9,1979), documenting the results of the initial review and identifying additional information needed from the applicant concerning the project.

4.

Preliminary review of a revised application submitted in December 1979 by Phillips to the State and forwarded to WMUR. However, since the application did not contain sufficient information on tailings management alternatives, Phillips was requested by the State (with the advice of WMUR staff) in February 1980 to reconsider its tailings disposal alternatives. NRC (Miller) advised the State (G. Stewart and W. Fleming) by telephone reiterated previous concerns expres' sed in the February 9,1979 letter. The need for Phillips to examine further the alternative of below grade burial to assure long-term stability was discussed.

_2-MAf211987 Subsequently (in March 1980), discussions between the State and WMUR resulted in postponement of WMUR staff's technical assistance efforts on the Phillips project.

Staff efforts on the Phillips case have been terminated and the case is considered complete, as of March 1980, pending further request from New Mexico for specific assistance.
