Dear Mr. Chairman:

Your letter of May 20, 1980, to Mr. Carlton C. Kammerer has been referred to me for a reply.

In your letter you attached a letter from Jane Branum for our consideration. Ms. Branum inquired, in her letter, about expansion of the Davis-Besse Nuclear Power Station and the reasons why any planned expan-sion may not take place.

We assume that Ms. Branum is referring to the application for construction permits for proposed Units 2 and 3 of the Davis-Besse Nuclear Power Station.

In a news release dated January 23, 1980, the Toledo Edison Company (Appli-cants) announced that the co-owners of the proposed Units 2 and 3 of Davis-Besse Nuclear Power Station have decided not to construct those units in view of " reduced growth projections, financial constraints and today's climate of over regulation." Based on that development, the counsel for the Applicants requested that the Atomic Safety and Licensing Appeal Board Panel terminate any further proceedings on the applications for construction permits for Davis-Besse Nuclear Power Station, Units 2 and 3.

No action has been taken on the Applicants' request, pending information as to whether the Applicants intend to withdraw their application or pursue some other course of action. Up to the present time, the Applicants have not with-drawn their application.
