NRC STAFF REQUEST FOR EXTENSION OF TIME IN WHICH TO FILE BRIEF IN OPPOSITION TO PETITIONERS' APPEAL FROM LICENSING BOARD'S ORDER DENYING PETITION TO INTERVENE On June 12, 1980, Petitioners Citizens Against Nuclear Power (CANP), James Runyon, and Edward Gogol filed a Notice of Appeal from the Licensing Board's

" Memorandum and Order Re: Contentions," dated May 30, 1980, pursuant to 10 CFR 5 2.714a.

In accordance with 10 CFR 2.714a, the NRC Staff brief in opposition to Petitioners' appeal is due on June 30, 1980. However, for good cause hereinafter shown, the Staff respectfully requests an extension of time, pursuant to 10 CFR 6 2.711, until July 10, 1980, within which to 4

file its opposing brief.

Coincident with preparation of the Staff brief in opposition to the instant appeal, Staff counsel was responsible for the preparation of responses to a Licensing Board Order in another NRC adjudication filed on June 24, 1980.

Counsel was out of the office on another case assignment from June 24 to June 26, 1980.

Upon returning to the office on June 27, counsel made a concerted effort to complete the brief for submission on June 30.

By late afternoon June 27, it became apparent that additional work was required in order to properly finalize the brief.

Counsel appreciates the tardy nature of this request but had hoped until then to avoid the need to seek an extension.

Accordingly, for good cause shown, the Staff respectfully requests the Appeal Board to permit it until July 10, 1980 to file its brief in opposition to Petitioners' appeal herein.
