This is in response to your request dated May 20, 1980, for an exemption to 10 CFR 70.51(e)(3) which would allow leeway in beginning physical inventories for low-enriched uranium.

This will also serve as acknowledge-ment of a telephone conversation between your Mr. T. E. Bowie and our Mr.

R. L. Jackson on June 4,1980.

Mr. Bowie wishes to amend your letter of May 20, 1980, by deleting the sentence, "These inventories will normally be take' during the periods of June 15-August 15 and December 15 to February 15" and be replaced with "These inventories will be conducted at intervals not to exceed 210 days."

We have determined that the granting of your request will not endanger the common defense and security and is otherwise in the public interest.

Accordingly, License Condition 5.2 of Amendment MPP-4 to ycur License No.

SNM-1067 is hereby added, effective immediately, to read as follows:

5.2 "Notwithstanding 10 CFR 70.51(e)(3)(ii), in order to allow for physical inventories to be conducted during plant cleanout for enrichment changesi physical inventories conducted in accordance with 10 CFR 70.51(f)(1) shall be performed at intervals not to exceed 210 days with a mininum of two inventories per calendar year."

As agreed to by Mr. Bowie in the aforement'ioned telephone conversation, it will be necessary for you to issue a modification of your May 20, 1980 letter to reflect the agreed to revision. Section 5.1 of your revised Fundamental Nuclear Material Control Plan should also be changed accordingly prior to submission for our review.
