Dear Mr. Mowry:
Subject:
(Export License Application XSNM01088)
By letters dated February 11, '977 and July 18, 1978 General Atomic requested a license authorizing the export of 24.4 kilograms uranium-235 contained in 26.2 kilograms uranium (93". enriched) for use in the Tehran Research Reactor.
Your requests were forwarded to the Department of State in order to obtain the views of the Executive Branch with respect to the proposed export.
On April 14, 1980, the Executive Branch informed us that the requirements of the Atomic Energy Act, as amended by P.L.95-242, have not been met in that there is no Agreccent for Cooperation between the United States and Iran, as required by Section 123 of the Act.
In addition, the Executive Branch is unable to make a detemination that the proposed export will not be inimical to the comon defense and security of the United States in view of current conditions in Iran.
Inasmuch as the requirements of Sections 53, 54c, 57c.(2),123 and 126 of the Atomic Energy Act of 1954, as amended, are not satisfied, your application for a license to export this material to Iran is denied.
Sincerely,
~e4.
