MINOR AENDMENT TO 10 CFR PART 34 TO SPECIFY LENG1110F TIE TO RETAIN CERTAIN RECORDS Attached for your signature is a FEDERAL REGISTER Notice to propose a minor amendment to 10 CFR Part 34, which concerns industrial radiography.
Discussion:
I am forwarding a minor proposed amendment to 10 CFR Part 34 to specify a length of time, two years, that records of the daily readings of pocket dosimeters must be retained. Presently such records must be kept until the Comission authorizes their disposal.
The amendnent would not change the licensee's responsibility to retain a record of the employee's dose based on film badge or TLD readings. The pocket dosimeter is a secondary dosimeter used in addition tt the film badge or TLD.
The retention time for the film badge or themolumines,, ant dosimeter (TLD) readings, which generally fom the long-tem record of the worker's dose, as required by $20.401(a), remains unchanged. These dose records must be kept until the Connission authorizes their disposal. In practice, the NRC has nct authorized licensees to dispose of official dose records. Additional discussion of the rationale for the proposed. amendment is contained in the statement of considerations accompanying the proposed amendment.
Ti.k mendment to the regulations would have no effect on Commission resources because we do not ask to see this infomation after an inspector has reviewed it once. Be::ause the amendment relates solely to a minor matter concerning retention of records and involves no substantive changes, it can be published in the Federal Register for connent under your signature.

i In accordance with 351.5(d)(3 ) of 10 CFR Part 51, neither an environmental impact statement nor a negative declaration need be prepared in connection with this rulemaking action because the environmental impact of the proposed action will be nonsubstantive and insignificant.
A note regarding issuance of the proposed rule will be included in the next Weekly Report to the Connission.
Coordination:
The Offices of Nuclear Material Safety and Safeguards and Inspection and Enforcement and the Division of Rules and Records concur in the proposed amendment. The Office of the Executive Legal Director has no legal objections.

MINOR AMENDMENT TO 10 CFR PART 34 TO SPECIFY LENGTH OF TIME TO RETAIN CERTAIN RECORDS I am recommending a minor amendment to 10 CFR Part 34 to specify a length of time, two years, that records of the daily readings of pocket dosimeters be retained.
Presently such records must be kept until the Commission authorizes their disposal.
This change conforms to NRC policy of specifying, wherever possible, how long records must be retained.
The amendment makes no substan-tive changes and can be made effective in 30 days with no public comment period.
A draft Federal Register Notice is attached.

';evertheless, we have the following comments to share with you.
1.
The finding that public procedure is " unnecessary" is cuestionable, inasmuch as some radiographic personnel might in principle have cause to object to the re-commended action.
However, we recognize that the potential for litigation seems highly remote, and that the issue could in any event be reopened if there were any suggestion from any affected persons that this course was warranted.
