Dear Mr. Chairman:
Enclosed.for your information are copies of a notice of proposed rulemaking to amend the Commission's regulations in 10 CFR Part 50, " Domestic Licensing of Production and Utilization Facilities." The proposed amendments delineate certain minimum fire protection requirements to be completed by November 1, 1980, at operating nuclear power facilities, and prohibits startup after that date of facilities that do not comply with those requirements.
The regulations presently contained in General Design Criterion 3, Fire Pro-tection, of Appendix A to 10 CFR Part 50 are general in nature and lack suffi-cient specificity to permit resolution of conflicting interpretations of NRC fire protection guidance bei. ween the licensees and the staff.
These proposed amendments set forth minimum requirements with respect to certain recurring generic fire protection issues for nuclear power facilities operating prior to January 1,1979.
The notice of proposed iulemaking is being sent to the Office of the Federal Register for publication in the Federal Register.
The notice allows 30 days for public comment following publication, after which time any necessary revi-sions will be made prior to publication of the amendments in final form.
Owing to the nature of these proposed amendments and the fact that the positions of tha staff and the licensees are documented and well known, we do not antici-pate extending the comment period.
Enclosed are copies of a public announcement which wil? be issued on this matter in the next few days.
