LICENSEE'S RESPONSE TO LETTER OF KAREN LEE MILLER On June 23, 1980, Licensee's counsel received an undated letter, postmar

- ~ ne 20, 1980, from Karen Lee Miller.

A copy of that lescer is attached.

Though the letter does not itself indicate who (besides Licensee) received copies of the letter, counsel for Licensee has verified by telephone call to the Office of the Secretary, Docketing and Service Branch that the Office of the Secretary received a letter from Ms. Miller which is similar in substance, although slightly different in wording.

Ms. Miller's letter is on its face, a " request (for]

a public hearing on the Commission's order for temporary modification of license dated 6/12/80."

. believe, however, that Ms. Miller intends to avail herself of the opportunity for hearing afforded by the Commission's June 12 Order.

The specific relief which she seeks - a delay in the commencement of venting-*/is inconsistent with the express provision in that Order that a request for a hearing pursuant to that Order will not stay the effectiveness of the Order.

" Order For Temporary Modification of License," at p.5.

Therefore, Licensee treats Ms. Miller's letter as a request to the Commission for reconsideration of its " Order For Temporary Modification of License" and for a hearing on the matter.

Licensee opposes both the proposed reconsideration and the requested hearing.

The Commission's " Order For 'femporary Modification of License" and companion " Memorandum and Order" (also dated June 12, 1980) reflect the Commission's careful consideration of a full record which included ample opportunity for public comment and participation in the decisica-making process.

Accordingly, Licensee urges the Commission to decline to reconsider its June 12 decision and to deny the requested hearing.
